CRIMINAL JUSTICE ACT VOUCHER REVIEW AND APPROVAL DELEGATION TO APPOINTED CJA JUDGE AND FEDERAL PUBLIC DEFENDER CJA RESOURCE COUNSEL EFFECTIVE APRIL 27, 2020

IT IS HEREBY ORDERED THAT:

1. The Federal Public Defender’s Criminal Justice Act (CJA) Resource Counsel is responsible for reviewing and approving requests for transcripts, travel, services other than counsel, as well as vouchers seeking payment for panel attorneys and other service providers, except as limited in paragraphs (4) and (5) below.

2. Pursuant to 18 U.S.C. § 3006A(d)(5), the Chief District Judge will appoint a Magistrate Judge to serve as the District’s CJA Judge with ultimate review and approval authority over requests for and payment of CJA funds reviewed and approved by the CJA Resource Counsel.

3. If the CJA Resource Counsel rejects or reduces a voucher, the CJA attorney may seek review, in writing, of that action by the CJA Judge.

4. The CJA Resource Counsel must consult with the CJA Judge on requests for atypical or high-cost services and may consult with the CJA Judge on any request. The CJA Judge must preapprove any atypical or unusually high-cost services.

5. With the exception of paralegals and investigators, the CJA Judge must preapprove the hiring of any service provider or expert whose fees will exceed $10,000 per case.

6. The Court reserves the right to perform an annual audit of approved vouchers and such
additional audits as circumstances warrant.
